1. Acceptance and Capacity

Use of this site constitutes unconditional acceptance of these Terms. You represent that you are at least 18 years of age or the age of majority in your jurisdiction. We may modify these Terms at any time by posting a revised version; continued use after posting constitutes acceptance of the revision.

2. Nature of the Publication

The Publication is an independent editorial project providing commentary, critical appraisal, and interviews concerning published orthopaedic literature. It is provided strictly for general informational and educational purposes. It is not a medical service, not a clinical reference, not peer-reviewed clinical guidance, and not a substitute for professional judgment of any kind.

3. Intellectual Property and Limited License

All original content on this site — text, editorial structure, design, graphics, illustrations, audio, and video — is the property of the Publication and is protected by copyright, trademark, and other laws. You are granted a limited, revocable, non-exclusive, non-transferable license to view content for personal, non-commercial use only. All other rights are reserved. Without our prior written consent you may not:

• reproduce, republish, distribute, or publicly display content;
• use content for any commercial purpose;
• scrape, crawl, harvest, or systematically extract content, or use any content to train, fine-tune, or evaluate artificial-intelligence or machine-learning systems;
• remove or alter attribution, copyright, or proprietary notices;
• frame or mirror any part of the site.

4. Prohibited Conduct

You agree not to interfere with the operation or security of the site, attempt unauthorized access, introduce malicious code, impersonate the Publication or its personnel, or use the site in violation of any applicable law or regulation.

5. Third-Party Services and Links

The site links to and integrates third-party services, including Substack (newsletter and video delivery), Vercel (hosting), Mux (video streaming), LinkedIn, and cited publishers. Those services are governed solely by their own terms and policies. We do not control and are not responsible for any third-party content, service, or site, and a link is not an endorsement.

6. Submissions

Any material you send us — emails, proposals, questions, suggestions — is non-confidential. By sending it you grant the Publication a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, edit, and publish it in connection with the Publication, with or without attribution, unless we agree otherwise in writing before your submission.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, COMPLETENESS, CURRENCY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY CONTENT REFLECTS THE MOST RECENT EVIDENCE, GUIDELINES, OR REGULATORY STATUS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLICATION AND ITS FOUNDERS, EDITORS, CONTRIBUTORS, GUESTS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, OR FOR ANY PERSONAL INJURY OR CLINICAL OUTCOME, ARISING FROM OR RELATING TO YOUR USE OF, OR RELIANCE ON, THE SITE OR ITS CONTENT, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH JURISDICTIONS OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Publication and its founders, editors, contributors, and guests from and against all claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the site, your violation of these Terms, or your violation of any law or third-party right.

10. Dispute Resolution — Arbitration and Class-Action Waiver

Any dispute arising out of or relating to these Terms or the site shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Michigan, USA. You waive any right to a jury trial and any right to participate in a class, collective, or representative action. Either party may instead bring an individual claim in small-claims court. Any claim must be filed within one (1) year of the date it arose or it is permanently barred. These Terms are governed by the laws of the State of Michigan, excluding its conflict-of-laws rules; for any matter found non-arbitrable, exclusive venue lies in the state and federal courts located in Michigan, and you consent to their jurisdiction.

11. General

If any provision of these Terms is held unenforceable, the remainder continues in full force, and the unenforceable provision is deemed modified to the minimum extent necessary. Our failure to enforce a provision is not a waiver. These Terms, together with the policies on this page, are the entire agreement between you and the Publication regarding the site.

Nothing on this site is medical advice. No physician–patient relationship is created by reading, watching, listening to, or corresponding with the Publication.

1. Educational Commentary Only

All content — literature reviews, editorials, summaries, interviews, video, and correspondence — is editorial commentary on published research, offered for education and discussion. It is not diagnosis, treatment, or a recommendation for or against any procedure, device, drug, or course of care for any person.

2. For Clinicians and Trainees

Content is directed at a professional audience for scholarly interest only. Clinicians must exercise their own independent professional judgment, verify all information against primary sources, current peer-reviewed literature, applicable clinical guidelines, and institutional protocols before making any clinical decision. The Publication accepts no responsibility for clinical decisions made in reliance on its content. Content may reference investigational or off-label uses; no such reference is a recommendation.

3. For Patients and the Public

If you are not a healthcare professional, do not use this site to make health decisions. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition, and never disregard or delay seeking professional advice because of something you read or watched here. If you think you may have a medical emergency, call your local emergency number (911 in the U.S.) immediately.

4. Interviews and Guest Statements

Statements made by interview guests are the personal views of the individual speaker at the time of recording. They do not represent the views of the speaker’s employers, institutions, or affiliated organizations, and do not represent the views of the Publication. Guests speak from their own experience; their statements are not clinical instructions.

5. Accuracy and Currency

Medical knowledge changes rapidly. Despite editorial care, content may contain errors or become outdated, and we make no representation that any content is accurate, complete, or current. Summaries of studies are interpretations, not substitutes for the underlying publications.

6. No Endorsements

Reference to any device, product, technique, company, or organization is for commentary only and is not an endorsement. Any future sponsorship is governed by our editorial-independence policy and will be disclosed; sponsors never influence editorial conclusions.

1. What We Collect

This site collects no personal information directly. We do not run advertising, analytics trackers, or marketing cookies of our own. The only personal data we handle is what you choose to send us:

• Newsletter subscription — the subscribe form submits your email address directly to Substack, which acts as the processor for the newsletter under Substack’s privacy policy.
• Correspondence — emails you send to conversationsinorthopaedics@gmail.com are retained as ordinary business records.

2. Third-Party Processing

Infrastructure providers may process technical data (such as IP address, browser type, and request logs) to deliver the site: Vercel (hosting), Substack and Mux (video streaming), and Google Fonts served through the build (self-hosted at deploy time). Embedded third-party content is governed by those parties’ policies.

3. Your Rights

Depending on your jurisdiction (including under GDPR, UK GDPR, and CCPA/CPRA), you may have rights to access, correct, delete, or restrict processing of your personal data, and to withdraw consent. For newsletter data, use the unsubscribe link in any email or contact Substack; for correspondence held by us, email conversationsinorthopaedics@gmail.com and we will honor verified requests within the time required by applicable law. We do not sell or share personal information for cross-context behavioral advertising.

4. Children

The site is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact conversationsinorthopaedics@gmail.com and we will delete it.

5. Changes

We will post any changes to this policy on this page with a revised effective date.

2. Cited Works

The Publication reviews and critiques published scientific literature. Quotations, citations, and references to third-party works are made for purposes of criticism, comment, scholarship, and education, consistent with the fair-use doctrine (17 U.S.C. § 107) and equivalent doctrines elsewhere. All cited works remain the property of their respective rights holders, and full citations are provided so readers can consult the original publications.

3. Permissions

Requests to reproduce our content — including for educational course packs, institutional distribution, or republication — should be sent to conversationsinorthopaedics@gmail.com with the content, purpose, and audience described. Unauthorized commercial reproduction will be treated as infringement and pursued to the fullest extent of the law.
